1. Introduction
Pescheria Spadari S.r.l. uses cookies and other tracking tools in compliance with Regulation (EU) 2016/679 (hereinafter, “GDPR”), Legislative Decree 196/2003 as amended (“Privacy Code”), Directive 2002/58/EC, the Italian Data Protection Authority (Garante) Decision of 8 May 2014 “Identification of simplified arrangements to provide information and obtain consent regarding cookies”, the subsequent “Clarifications on the implementation of cookie legislation” of 5 June 2015 and the “Guidelines on cookies and other tracking tools” of 10 June 2021 (together, the “Applicable Law”).
This document provides information about the technologies that allow the website www.pescheriaspadari.it (hereinafter, the “Site”) to collect and store information on the user’s device, or to access information already stored on it, when the user interacts with the Site. For simplicity, these technologies are referred to below as “Tracking Tools”, unless there is reason to distinguish between them.
Some Tracking Tools require the user’s consent. Consent is free and optional, and may be withdrawn or changed at any time as described in section 4.
The Site may use Tracking Tools managed directly by the Controller (“first-party”) and Tracking Tools that enable services provided by third parties (“third-party”). The duration and expiry of Tracking Tools may vary according to the settings of the Controller or of each third-party provider; some expire at the end of the browsing session.
2. Definitions
Personal Data (or Data): any information which, directly or indirectly, including in connection with any other information, identifies or makes identifiable a natural person.
User: the individual using the Site who, unless otherwise specified, is the Data Subject.
Data Subject: the natural person to whom the Personal Data relate.
Data Controller (or Controller): the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.
Data Processor (or Processor): the natural or legal person who processes personal data on behalf of the Controller.
Cookie: Tracking Tools consisting of small pieces of data stored in the user’s browser.
Tracking Tool: any technology – such as cookies, unique identifiers, web beacons, embedded scripts – that makes it possible to collect or store information on the user’s device.
3. Cookies and tracking tools
Cookies are small text strings that a website sends to the user’s device, where they are stored and then sent back to the same website on the next visit. A Tracking Tool is any technology, such as cookies, unique identifiers, web beacons, embedded scripts and similar technologies, that makes it possible to collect or store information on the user’s device.
Cookies differ according to their function: some are strictly necessary for browsing the Site or for providing a service requested by the user; others serve further purposes, such as statistical measurement, embedding third-party content or personalised advertising, and therefore require the user’s consent before they are set.
Tracking Tools are divided into the categories described below. The Site sets only Tracking Tools in the “Necessary” category without asking for consent; all Tracking Tools in the other categories are set only after the user has given consent through the banner or the preference centre.
The up-to-date, detailed list of the individual Tracking Tools in use, including the provider, purpose and duration of each, can be consulted at any time in the preference centre, reachable from the “Cookie preferences” link at the bottom of every page of the Site.
3.1 Necessary
The Site uses so-called “technical” cookies or similar Tracking Tools to carry out activities strictly necessary for the Site to work or to provide the service requested by the user. This category includes browsing or session cookies, cookies that keep the Site secure and cookies that store the user’s cookie choices.
Setting these tools does not require the user’s consent. Disabling them through the browser settings may cause the Site, or parts of it, to malfunction. The user’s cookie choice is stored for six months, unless in the meantime the user changes it or the Tracking Tools in use change.
3.2 Experience
This category includes Tracking Tools used to improve the quality of the browsing experience and to enable interaction with external content, networks and platforms embedded in the pages of the Site (for example, embedded media or maps). These Tracking Tools are set only with the user’s prior consent.
3.3 Measurement
This category includes analytics cookies and Tracking Tools used to measure traffic and analyse user behaviour in order to improve the Site. Under the Garante’s Guidelines of 10 June 2021, consent is not required when analytics tools are used solely to produce aggregate statistics, reduce the identifying power of cookies (for example, by masking parts of the IP address) and, if managed by third parties, the provider acts as data processor and does not combine the data with other information it holds. In all other cases, Tracking Tools in this category are set only with the user’s prior consent.
3.4 Marketing
This category includes profiling cookies and Tracking Tools used to deliver personalised ads or promotional content and to measure their performance. These Tracking Tools are set only with the user’s prior explicit consent.
3.5 Third-party Tracking Tools and external links
The Site contains links to third-party services and platforms, such as Pescheria Spadari’s pages on the Facebook and Instagram social networks and online booking platforms (e.g. TheFork). The mere presence of a link does not cause those parties to set Tracking Tools; however, these services are accessed on websites run by their respective owners, who may use their own Tracking Tools under their own privacy notices, which we encourage you to read. The Controller has no control over those tools.
4. How to manage preferences and give or withdraw consent
4.1 Banner and preference centre
On the first visit to the Site, and whenever circumstances require it, a banner is shown that lets the user accept all Tracking Tools, reject them all, or choose individual categories through the preference centre. Rejecting is as easy as accepting. If the user closes the banner without making a choice, the Site remains usable with necessary Tracking Tools only. Continuing to browse, scrolling the page or other actions do not amount to consent.
The user can change their choices, or withdraw consent already given, at any time by clicking the “Cookie preferences” link at the bottom of every page of the Site. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal. The banner is not shown again for six months after the last choice, unless the Tracking Tools in use have changed significantly or the user has changed their preferences.
For third-party Tracking Tools, the user can also manage their preferences through the relevant opt-out link (where available) or using the tools described in the provider’s privacy policy.
4.2 Browser settings
Users can use their browser settings to view the cookies stored on their device, block them or delete them.
Information on managing cookies in the most common browsers is available at the following addresses:
4.3 Consequences of refusal
Users are free to decide whether or not to allow Tracking Tools other than necessary ones. Refusing does not affect access to the Site or the use of its essential content and services; however, it may not be possible to view some third-party content embedded in the Site or to use related features.
